Winner Release

Version: winner-release-1.0 (effective 17 September 2026)
Applies to: every prize accepted under the Ardor Monthly Draw Official Rules, version 1.x or later.
Language: English. A French version is published at ardor.fitness/winner-release-fr and has equal force for residents of Quebec and France.

You have been selected as the provisional winner of a monthly Contest of the Ardor Monthly Draw (the “Draw”) run by Arduous Inc., doing business as Ardor, PO Box 534, Squamish, British Columbia V0N 1H0, Canada (“Ardor”). Capitalised terms have the meaning given in the Official Rules at ardor.fitness/draw-rules (the “Rules”).

To receive your prize you must read this document and confirm your agreement in the app by ticking “I agree to the Winner Declaration & Release” and tapping Accept Prize. Doing so is your electronic signature. If you do not agree, do not accept the prize; Ardor will select another winner under the Rules.

1. My declaration

By accepting, I declare that each of the following is true:

1.1 I have reached the age of majority in the place where I live.

1.2 I am a legal resident of the country and region I declared in the app, which is an Eligible Region under the Rules, and I was a resident there when I earned my Entries and at the moment the draw was executed.

1.3 I am not an excluded person under section 4.4 of the Rules. In particular, I am not an employee, contractor, director or officer of Ardor; not a member of the immediate family or household of one; not a Featured Athlete, Ardor-partnered athlete or creator, or prize provider, or a member of their immediate family; and I do not hold an internal test account.

1.4 I have not won a Contest of the Draw in the twelve (12) Contests before this one.

1.5 I participate through a single Ardor account, which is my own, and every Entry in that account was earned by my own genuine activity in accordance with the Rules.

1.6 I answered the skill-testing question myself, without assistance from any person or device.

1.7 The contact email address I confirmed in the app is mine and Ardor may use it to deliver the prize and to communicate with me about it.

1.8 Everything I have told Ardor in connection with the Draw is true, and I understand that a false statement means I forfeit the prize and Ardor may select another winner.

2. The prize I am accepting

2.1 I accept the prize described in the In-App Prize Disclosure for this Contest, at its approximate retail value stated there, and on the terms in section 10 of the Rules.

2.2 I understand and agree that: the prize is not cash and cannot be exchanged for cash; it cannot be transferred, resold or assigned to anyone else; Ardor may substitute a prize of equal or greater value only if the stated prize becomes unavailable or the law requires it; a gift card or voucher is subject to its issuer’s terms, expiry and regional limits; subscription time is applied to my own Ardor account only; and any cost not expressly included in the prize description is mine.

2.3 If the prize is an experience (for example, a video session with a Featured Athlete), I will schedule it in good faith with Ardor and the provider within the time the Rules allow, and I understand that failing to attend a scheduled session without reasonable notice forfeits the prize.

2.4 I will provide any reasonable proof of identity, age or residence Ardor requests before delivery, and I understand Ardor may withhold the prize until it is provided.

3. Release

3.1 In consideration of receiving the prize, and to the fullest extent permitted by the law of the place where I live, I release and discharge Ardor, the provider of my prize, the Featured Athlete for this Contest, and each of their directors, officers, employees, contractors, agents and successors (together the “Released Parties”) from any and all claims, demands, losses, damages, costs and liabilities of any kind that arise from or relate to: (a) my participation in the Draw; (b) the selection of winners; (c) the acceptance, delivery, possession, use or misuse of the prize; and (d) any activity I undertake in connection with an experience prize, including physical training.

3.2 If my prize includes any physical activity, coaching, or a training session with an athlete, I understand that exercise carries inherent risks of injury. I confirm that I am in adequate health to take part, that I have consulted a physician if I have any doubt, and that I take part voluntarily and at my own risk. A Featured Athlete’s advice during an experience is general and not a medical or individualised prescription.

3.3 The prize provider’s only role is supplying the prize. I will not hold the provider responsible for any aspect of the Draw’s conduct, and I will not hold Ardor responsible for the provider’s products or services beyond Ardor’s obligation to deliver the prize as described.

3.4 Nothing in this section limits or excludes any liability for death or personal injury caused by negligence, for fraud, or any other liability, right or remedy that cannot be excluded or limited under the consumer protection law of the place where I live, including the Australian Consumer Law, the UK Consumer Rights Act 2015, applicable EU consumer law, and Quebec’s Consumer Protection Act.

4. Publicity (optional)

4.1 Ardor asks for my consent to name me publicly. This is optional. Whether I consent or not has no effect on my prize.

4.2 If I tick “Yes, you can announce my win with my first name and region”, I grant Ardor a non-exclusive, worldwide, royalty-free licence to publish my first name and my region only (for example, “Alex, British Columbia”), together with the Contest and the prize, in the Ardor app, on ardor.fitness, in Ardor’s email and social channels, and in the public winners record, for the purpose of announcing the result and promoting the Draw, without further notice, approval or compensation. Ardor will not publish my surname, photograph, likeness, voice or any other personal detail under this consent. If Ardor later wants to feature me in any other way, it will ask me separately.

4.3 I may withdraw this consent at any time by emailing support@ardor.fitness. Ardor will then stop using my name in new publications and will remove it from the winners record and from content Ardor controls within a reasonable time; Ardor cannot recall material already distributed by third parties.

4.4 If I do not tick the box, Ardor will not name me. The public winners record will show only the Contest, the prize and an anonymised description of the winner (for example, “October 2026: a member in Vancouver”). Ardor will still confirm my region, but not my name, to anyone who requests winner information under section 13.4 of the Rules, unless the law where I live requires more, in which case Ardor will tell me before disclosing.

5. Taxes

5.1 The prize is delivered gross. Any income, gift or other tax, levy, duty or reporting obligation arising from my receipt of the prize is my responsibility, and I will pay it. Ardor does not withhold tax and provides no tax advice.

5.2 Where the law of the place where I live requires Ardor to report or withhold, Ardor will comply, and I will provide the information Ardor reasonably needs to do so.

6. Signed form where required

6.1 In-app acceptance is a binding electronic signature under the law of British Columbia and Canada, and Ardor relies on the equivalent laws of the Eligible Regions (including the United States E-SIGN Act and UETA, the UK Electronic Communications Act 2000, and the EU eIDAS Regulation).

6.2 If the law of the place where I live, the nature of my prize, or Ardor’s verification under section 2.4 requires a signed declaration, Ardor will email me the form in Annex A. I will return it, signed, within seven (7) days of the email. Ardor may withhold delivery until it is returned and may select another winner if it is not.

7. Privacy

Ardor processes the information I provide in accepting the prize (my confirmed email, my declarations, my publicity choice, the acceptance timestamp and this document’s version number, and any verification documents) to deliver the prize, to keep a record of the Draw, and to meet legal obligations. Ardor’s Privacy Policy at ardor.fitness/privacy-policy applies. Verification documents are deleted once verification is complete unless the law requires retention.

8. General

8.1 This document and the Rules together are the entire agreement between me and Ardor regarding the prize. If they conflict, this document governs the prize and the Rules govern everything else.

8.2 This document is governed by the laws of British Columbia and the federal laws of Canada applicable there, on the same terms as section 17 of the Rules, including the protection of any mandatory consumer law of the place where I live.

8.3 If any part of this document is held unenforceable where I live, the rest continues in force there.

8.4 Ardor keeps a record of my acceptance, including the version of this document I agreed to, and will send me a copy on request to support@ardor.fitness.
